In the dynamics of the international trade, the Government of India from time to time imposes restrictions on imports and exports of certain products, these restrictions are placed due to various reasons, some of which are Protection of public morals , Protection of human, animal or plant life or health , and environment, security and exhaustible natural resources. strategic goods controls, health concerns, and other reasons.

However, in genuine cases, the DGFT office of the Ministry of Commerce with the help of concerned ministries regulating the notified products gives relaxation for import or export to the specific importer or exporter by way of Authorisation. 

Further to regulate Import and Export, certain items come under the Tariff Rate Quota (TRQ) system and certain notified items/types of items are strictly PROHIBITED for trade.

How to Import or Export restricted goods in India :

Restricted goods can be imported or exported through licence which is granted by the DGFT office of the Ministry of Commerce. A facilitation committee, comprising representatives of relevant technical authorities and departments, may provide assistance and advice.

As of now, majorly following items are restricted for imports :  –

  • Laptop , Servers etc. (effective from 1.11.2023)
  • Gold /Silver dore
  • Scrap of Lead Acid Batteries / used metals like iron and steel products 
  • PET Flakes, plastic waste, tyres and tyre scraps
  • Refrigerators, ACs, different types of refrigerant gases, chemicals and alcohols
  • Animal Origin Products such as bovine/horse semen, hunting trophies, taxidermy, Feeding supplements of Livestock  etc.
  • Used cooking oil, used engine oil, some specific types of fuels.
  • Propellant and TNT explosives etc
  • Sandalwood
  • Old equipment containing electronic parts, other recyclable items
  • Different varieties of Rice like Jasmine rice, Thai rice etc
  • Radar, Sensors, Drones and other defence equipments
  • Import of Second-Hand Goods*
  • And other notified items as per the Foreign Trade Policy

*Importing second-hand capital goods is restricted and allowed only in accordance with policy provisions or specific licences/certificates/permissions. Some items may be imported without a licence, such as second-hand capital goods (excluding certain items) and metallic waste, scrap, seconds, and defects below a specified value.

What are the other mandatory compliances in Import or Export of certain goods?

Apart from the above, there are some Non-Tariff Barriers which restrict the flow of the trade by mandating additional compliance requirements on notified products. The Non-tariff barriers on imports and exports involve various certifications and mandatory quality control standards. What is a Sanitary Import Permit (SIP) and why it is required:

Importers of animal products must present a Sanitary Import Permit at customs before entry into the country. Products covered include meat and meat products, eggs, milk and milk products, pet food, embryos, ova or semen, and other livestock products.

Why WPC Approval is required: 

Without DOT’s WPC or MTCTE approval, the import of notified wireless and telecom equipment are not allowed.

What are Technical Standards for Quality :

The government has subjected imports of some products to mandatory compliance with Indian Quality Standards. The foreign manufacturers and exporters are required to register with the Bureau of Indian Standards (BIS) to comply with registration requirements for certain electronic goods.
